CONSUMER HEALTH DATA PRIVACY STATEMENT

This Consumer Health Data Privacy Statement (the “Statement”) supplements the ASICS Privacy Policy and applies to personal data collected by ASICS Runkeeper that is defined as “consumer health data” subject to health privacy laws in Washington State and Nevada. This Statement does not address or apply to ASICS’s collection and processing of personal information that is not consumer health data or that is collected and processed outside of ASICS Runkeeper, such as on the ASICS websites. This Statement uses certain terms that have the meaning given to them in the Washington My Health My Data Act (the “MHMDA”) and Nevada Senate Bill 370 (“SB 370”).

ASICS Runner App Inc. and its affiliates and subsidiaries (collectively, “ASICS,” “us,” “we,” or “our”) are committed to privacy and transparency. In the event of a conflict between this Statement and any other ASICS privacy policy, notice or statement, this Statement will prevail with respect to the “consumer health data” subject to this Statement.

In certain contexts, ASICS may act as a Service Provider to other businesses. For example, when ASICS operates as a Service Provider to our selected wholesalers and retailers. In that capacity, ASICS may receive some limited personal data from these third parties to facilitate fulfillment, return or other services for them, such as to ship ASICS products directly to customers. Please note that to the extent ASICS is a Service Provider, the processing of the personal data ASICS receives is subject to the respective third parties’ privacy policy, not this Statement.

  1. Collection and Use of Consumer Health Data

As described in the ‘Personal Data We Collect’ section of the ASICS Privacy Policy, the data we collect on ASICS Runkeeper depends on how you interact with us, including the services you use, and the choices you make. Because consumer health data is defined very broadly under MHMDA, many of the categories of data we collect on ASICS Runkeeper could be considered consumer health data.

Such data may also be categorized as follows:

  • Information about your health-related conditions, including your pregnancy and disability status. For example, we may collect such information through third-party or health platform integrations or through information that you provide to us in free text fields.
  • Information that could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your or another person’s health. For example, your interactions with us could involve queries concerning nutrition, wellness, fitness, medical conditions, or other health-related topics.
  • Activity data and other information you provide when using ASICS Runkeeper, including your sex, gender, age, foot and clothes size and other personal measurement information and activity data that you voluntarily share with us. Voluntarily shared information may include photographs, which may also be considered biometric information under the MHMDA, information that you import from other apps or services from our partners or third parties, and information such as weight, height, heart rate, V02 Max, calories burned, steps taken, foot type (e.g., tendency to pronate or supinate), nutrition information, sleep activities, fitness level, stress level, feeling rating or comments, other activity data (including route information, type, duration and frequency of fitness activities, elevation, distance, speed, pace, cadence, stride, step count) and injuries.
  • Your running specifics, including your current running shoe, which running type you are and the level of your running, along with your fitness achievements.
  • Your location information, including, depending on the Services you use and with your permission, your location, accelerometer, timers, or your running route (including precise geolocation data that shows your geographical position).
  • Data we infer about you, including behavioral insights and health indicators. For example, we may make inferences about your health based on your activity frequency, intensity, and preferences, as well as your fitness goals.
  • Other data from connected services and imports, including from third-party integrations, social connections information, health platforms, and your file imports, as well as app technical and usage data, such as session durations, feature usage, and click behavior, which may be used to infer or derive data related to the above or other health information.

2. Purposes for Collection and Use of Consumer Health Data

We collect and use consumer health data for the purposes described in the ‘How We Use Your Personal Data’ section of the ASICS Privacy Policy. For ASICS Runkeeper, we collect and use consumer health data as reasonably necessary to provide you with the features and services available in ASICS Runkeeper. This may include delivering and operating the ASICS Runkeeper, personalization of certain features in ASICS Runkeeper, addressing the secure and reliable operation of ASICS Runkeeper and the systems that support it, troubleshooting and improving ASICS Runkeeper, and other essential business operations that support the provision of ASICS Runkeeper (such as analyzing our performance, meeting our legal obligations, and conducting research and development). These purposes may include:

  • Fulfilling our Obligations, including to perform our agreements with you when you request and use ASICS Runkeeper and to comply with our legal obligations.
  • Community Building, including to connect users with local running groups or events, fostering a sense of community.
  • Health Monitoring, including to track vital health metrics such as heart rate, sleep patterns, and overall fitness levels.
  • Injury Prevention, including to analyze running patterns and suggest adjustments to prevent injuries.
  • Performance Tracking, including to monitor and analyze running performance, including distance, speed, and calories burned.
  • Personalization, including to provide personalized training plans and recommendations based on individual health data and fitness goals.
  • Motivation and Engagement, including to set goals, provide feedback, and offer motivational insights to keep users engaged and motivated.
  • Nutritional Guidance, including to provide dietary recommendations and track nutritional intake in conjunction with fitness goals.
  • Safety and Emergency Response, including to detect unusual health metrics or incidents (like falls) and alert emergency contacts or services.
  • Social Sharing, including to enable users to share their progress and achievements with friends or on social media platforms.
  • Planning and Managing Events, including to plan and manage our events and races we host or sponsor, including registration, attendance, inviting you to connect you with other event attendees, and contacting you about relevant events.
  • Security, including to process certain personal data for security and fraud prevention and detection purposes as well as to help maintain the integrity of our systems.
  • Research and Development: To gather data for improving app features and conducting health-related research.

We may also use consumer health data for other purposes for which we give you choices or obtain your consent as required by law. See the ‘Your Rights’ section of the ASICS Privacy Policy and the Consumer Health Data Rights section below for more details on the controls and choices you may have.

3. Sources of Consumer Health Data

As described further in the ‘Personal Data We Collect’ section of the ASICS Privacy Policy, we collect personal data (which may include consumer health data) directly from you and your devices, from your interactions with ASICS Runkeeper, from third-party devices and apps you choose to connect to ASICS Runkeeper, from our affiliates and subsidiaries, and from vendors who provide services on our behalf.

4. Sharing of Consumer Health Data

We may share each of the categories of consumer health data described above for the purposes described in the ‘How We Share Your Personal Data’ section of the ASICS Privacy Policy. In particular, we may share personal data, including consumer health data, with your consent or as reasonably necessary to complete any transaction or provide any product you have requested or authorized, as described in the previous section above.

For example, if you make a purchase, we will share information about the transaction as necessary to process the payment, including protection against fraud. And we may disclose data when we believe that doing so is necessary to comply with applicable law or respond to valid legal processes. Where required by applicable law, we will obtain your consent to share your consumer health data.

5. Third Parties and Affiliates with Which We Share Consumer Health Data

As necessary for the purposes described above, we share consumer health data with the following categories of third parties:

  • ASICS Runkeeper users. If you direct us to do so (e.g., such as via your ASICS Runkeeper account and settings), we may share certain information, such as your training and running data, with other ASICS Runkeeper users, including users you are connected with.
  • Partners. We may share consumer health data with other companies, for example, where you use a service that is cobranded and jointly operated with another company, or where you use our services to interact with another company.
  • Financial institutions & payment processors. When you make a purchase or enter into a financial transaction, we will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
  • Parties to a corporate transaction. We may disclose consumer health data as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.
  • Affiliates. We enable access to data across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business.
  • Government agencies. We will disclose consumer health data to law enforcement or other government agencies when we believe doing so is necessary to comply with applicable law or respond to valid legal process.
  • The public. You may select options available through our services to publicly display and disclose certain information, such as your profile, demographic data, content and files, or geolocation data, which may include consumer health data.
  • Third parties in case of a legal requirement. We may also disclose your personal data if we believe we are required to do so by law, or that doing so is reasonably necessary to comply with legal processes; when we believe it is necessary or appropriate to disclose personal data to law enforcement authorities, such as to investigate actual or suspected fraud or violations of law, breaches of security, or breaches of our policies; to respond to any claims against us; and, to protect the rights, property, or personal safety of ASICS, our customers, or the public.

We also may disclose your consumer health data to our service providers, including vendors or agents working on our behalf, which may access consumer health data for the purposes described above. For example, companies we’ve hired to provide customer service support or assist in protecting and securing our systems and services may need access to data to provide those functions.

6. Consumer Health Data Rights

You have certain rights and choices regarding our use and disclosure of your consumer health data, as described below.

  • Confirm: You have the right to request that we disclose to you whether we collect, share or sell your consumer health data.
  • Access: You have the right to request access to, and information about, the consumer health data we have collected, shared or sold about you.
  • Delete: You have the right to request that we delete your consumer health data.

Withdraw Consent: If, where required under applicable law, you have provided us with your consent to collect, use and share your consumer health data,
you have the right to withdraw this consent.

If your request to exercise a right under the MHMDA is denied, you may appeal that decision by contacting our privacy support team via our web form. If your appeal is unsuccessful and you are a Washington State resident, you can raise a concern or lodge a complaint with the Washington Attorney General at https://www.atg.wa.gov/file-complaint.
